The precarium is the transfer of, for example, a property for a non-binding loan. In contrast to a rental agreement, the precarium can be revoked at any time. The precarium is not subject to the Tenancy Act. The precondition for a precarium is that the property is transferred free of charge.
Whether even minor consideration, the assumption of operating costs or payments to maintain gratuitousness are detrimental must be clarified on a case-by-case basis.
